Terms of service

Terms of Service

In short

  • These Terms apply when you use cherryblossomla.com or order from Cherry Blossom Flowers.
  • Our Delivery & Pickup Policy, Refund Policy and Privacy Policy are part of these Terms.
  • One discount per order. CB Points and discount codes have no cash value. We don’t sell gift cards.
  • If something goes wrong, contact us first — most problems are solved with one call.

1. Who we are

Cherry Blossom Flowers is a flower shop at 6201 Hollywood Blvd, Los Angeles, CA 90028. It is Luxqr Inc., doing business as Cherry Blossom Flowers (“Cherry Blossom Flowers”, “we”, “us”). These Terms of Service (“Terms”) govern your use of cherryblossomla.com (the “Site”) and any order you place with us. By using the Site or placing an order, you agree to these Terms. If you don’t agree, please don’t use the Site.

2. Ordering

You must be at least 18 years old, or have a parent’s or guardian’s permission, to place an order. You agree to give accurate and complete information, including delivery details. We deliver only within our delivery area in the Los Angeles area.

Your order is accepted when we send an order confirmation. We may refuse or cancel any order, including after confirmation, for example if an item is unavailable, the address is outside our area, there is an error in price or description, or we suspect fraud or misuse. If we cancel, we refund the full amount you paid.

Weddings, events and other custom work are arranged through a separate written proposal. Its terms, including any deposit and cancellation rules, apply where they differ from these policies.

3. Our flowers and photos

Every arrangement is made by hand from seasonal flowers, so your bouquet may differ from the photos on the Site, which show an example. Colors may look different on different screens, and sizes are approximate. Substitutions are described in our Refund Policy.

Flowers and plants are not food. Some can cause allergic reactions or be harmful to people or pets if eaten — for example, lilies are highly toxic to cats. Please keep flowers out of reach of children and pets and check for allergies before sending. If something matters for the recipient’s health, tell us in the order notes; we’ll do our best, but we can’t guarantee that an arrangement is free of any particular plant or pollen.

4. Prices and payment

Prices are in US dollars and may change at any time before you place an order. The full price of your order, including any paid vase or gift, the delivery fee and any applicable sales tax, is shown at checkout before you pay. We charge more after you order only for something you ask for later — such as a timed delivery, a redelivery, a farther address or a more expensive product — and only after we confirm the amount with you. Payments are processed by Shopify and its payment partners (including Shop Pay, Apple Pay and Google Pay). We don’t receive or store your full card number.

5. Delivery, pickup, changes and refunds

Delivery, pickup, changes, cancellations, quality issues and refunds are governed by our Delivery & Pickup Policy and our Freshness Promise & Refund Policy, which form part of these Terms.

6. Card messages and recipient details

You are responsible for the content of your card message and for having the recipient’s permission to share their name, address and phone number with us. We print or write your message as you entered it and aren’t responsible for errors in the text you provide. We may decline a message that is unlawful, threatening, harassing or offensive. We keep the sender’s identity confidential. If the recipient asks who sent the flowers, we don’t say, unless your name is in the card message, you confirm by email that we may share it, or the law or someone’s safety requires it.

7. Photos of our work

Our team may photograph the arrangements we make, including your order, to send you a photo before delivery, to confirm delivery, and to show our work on the Site and social media. Photos we publish never include your name, the recipient’s name, an address or the card message. If you’d rather we didn’t publish photos of your order, tell us in the order notes or by email.

8. Accounts

You can sign in to your account with a one-time code sent to your email or with Google. You are responsible for activity in your account and for keeping access to your email secure. We may suspend or close an account that is used for fraud or misuse, or that breaks these Terms.

9. Discount codes and promotions

  • One discount per order: a welcome code, a gift code from our studio, or CB Points (as a code in your bag or as store credit). They can’t be combined. If an order uses more than one, we may cancel it with a full refund.
  • Discount codes have no cash value, can’t be exchanged for cash and can’t be applied to past orders.
  • Each code is valid only for its stated terms and until its stated expiration date. Gift codes from our studio are a personal thank-you to our customers; they are single-use and valid for 90 days.
  • The welcome code from our email sign-up is for a first order only, one per customer.
  • Unless stated otherwise, codes apply to products, not to delivery fees.
  • We may cancel a code, or an order using it, if the code was obtained or used through fraud, multiple accounts, automated tools or resale.
  • We may change or end a promotion at any time. This doesn’t affect codes already issued.

We don’t sell gift cards. Discount codes, CB Points and store credit are not gift cards.

10. CB Points

CB Points is our rewards program for customers with an account. The full rules are on our CB Points page; in short:

  • You earn 10 points for every $1 you pay for flowers and gifts, after discounts and points used. Delivery and tips don’t earn points. Points are added once your order is delivered or picked up.
  • 1,000 points = $5. Once you have at least 1,000 points, you can use them in your bag as a single-use code — up to the price of the flowers, with the rest staying for next time — or turn them all into store credit in your account. A points code in your bag is valid for 7 days; if it isn’t used, the points return to your account.
  • Points count as your one discount for the order (section 9).
  • Points expire if you don’t place an order for 12 months.
  • Points have no cash value and can’t be transferred, sold or combined between accounts.
  • We may correct points added by mistake and remove points earned through fraud or misuse.
  • We may update the rules. Changes don’t reduce points you’ve already earned. If we ever close the program, we’ll give at least 30 days’ notice on the Site so you can use your points.

11. Messages from us

We send emails and texts about your order: confirmations, delivery updates, the photo you asked for and questions about delivery. We send marketing emails only if you sign up, and you can unsubscribe at any time using the link in any email.

We don’t send bulk or automated marketing texts. We text only: the bouquet photo you asked for; replies in a conversation you started with us; messages needed to deliver your order; and, occasionally, a personal thank-you code from one of our florists to a customer who has ordered from us. Reply STOP or tell us in any other way, and we’ll stop texting you. Message and data rates may apply.

Replies in our website chat come from our florists, and chat messages are saved and shared with our team (see our Privacy Policy). Chat answers are general information; the terms of your order are those in your order confirmation and these Terms. A change to your order — such as a new time, address or card message — takes effect only when we confirm it in writing (by text, email or in chat) and record it in your order.

12. Reviews and content you send us

If you post reviews, photos or other content about us publicly, tag us, or send it to us for publication, you keep ownership of it and give us a free, non-exclusive, worldwide, perpetual license to use, reproduce and display it in connection with our business. This doesn’t cover photos and messages you send us privately about an order or a complaint; we use those only to handle your order. Please send only content you have the right to share and that doesn’t violate anyone’s rights.

13. Our photos and content

All photos, videos, texts and designs on the Site and on our social media pages, as well as our name and logo, belong to Cherry Blossom Flowers or are used by us under license, and are protected by copyright and trademark law. You may share a link to the Site or repost our social media posts using the platform’s own sharing features.

You may not copy, download, edit or use our photos or other content for any commercial purpose without our written permission — for example, on another website, online store or marketplace listing, social media account or advertisement, or to offer or sell flowers or other products. If we find our content used without permission, we may require its removal, send takedown notices to the website, platform or hosting provider, and seek all remedies available under copyright and trademark law, including damages. To ask for permission, email info@cherryblossomla.com.

You also agree not to misuse the Site, including by interfering with its operation, using bots or scrapers, attempting unauthorized access or abusing promotions.

14. Disclaimers and limitation of liability

The Site is provided “as is” and “as available”. Our flowers and products come with the Freshness Promise in our Refund Policy. To the fullest extent permitted by law, we are not liable for indirect, incidental, special or consequential damages, including a missed occasion or event, and our total liability for any claim relating to an order is limited to the amount you paid for that order.

Nothing in these Terms limits liability for fraud, intentional or grossly negligent conduct, personal injury, or violation of law, or any other liability that cannot be limited under applicable law.

15. Claims by others

If someone else makes a claim against us because of the content of your card message, or because you gave us a recipient’s details without their permission, you agree to cover our resulting losses and reasonable costs, to the extent permitted by law.

16. Circumstances beyond our control

We aren’t responsible for delays or failures caused by events outside our reasonable control, such as severe weather, wildfires, natural disasters, power or internet outages, road closures, public safety events, supplier shortages or actions of authorities. Our Delivery & Pickup Policy explains what we do in these cases.

17. Resolving disputes

Talk to us first. Most problems are solved with one call. Before starting any claim, please contact us at info@cherryblossomla.com or (323) 493-1514 with your name, contact details, order number, a description of the problem and what you’re asking for, so we can try to resolve it; most problems are solved within a day or two. This request doesn’t limit your right to contact your bank or card issuer, or any other right you have under law.

Small claims. If we can’t resolve it, either of us may bring an individual claim in small claims court in Los Angeles County, if the claim qualifies.

Courts. Any other dispute will be heard in the state or federal courts located in Los Angeles County, California.

18. Governing law

These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules.

19. Changes and other terms

We may update these Terms by posting a new version on the Site with a new effective date. Changes don’t apply to orders placed before the change. If any provision is found unenforceable, the rest of the Terms remain in effect. Our failure to enforce a provision is not a waiver. These Terms and the policies they refer to are the entire agreement between you and us about the Site and your orders.
